Welcome to Gymbo! These Terms of Service ("Terms") govern your use of the Gymbo mobile application (the "App") operated by Gymbo ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
## 1. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
## 2. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access to your account
- You may not share your account or allow others to access it
## 3. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Upload malicious code or content
- Impersonate others or misrepresent your affiliation
- Use the App to harass, abuse, or harm others
- Reverse engineer or attempt to extract source code
- Use automated systems to access the App without permission
## 4. Health Disclaimer

- Gymbo provides fitness tracking and AI-powered guidance for informational purposes only
- Bo, our AI coach, provides general fitness suggestions, not medical advice
- Always consult a qualified healthcare provider before starting any exercise program
- If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention
- We are not liable for any injuries resulting from exercises performed based on App suggestions
## 5. AI Coach (Bo)
- Bo uses artificial intelligence to provide fitness guidance based on your data
- AI responses are generated and may not always be accurate or appropriate for your situation
- Bo's suggestions should be considered general guidance, not professional instruction
- We do not guarantee the accuracy, completeness, or usefulness of AI-generated content
## 6. Subscription and Payments
- Certain features may require a paid subscription
- Subscription fees are billed in advance on a recurring basis
- You can cancel your subscription at any time through your device's app store
- Refunds are handled according to Apple App Store or Google Play Store policies
- We reserve the right to change subscription pricing with reasonable notice
## 7. Intellectual Property
- The App, including its design, features, and content, is owned by Gymbo
- You retain ownership of the data you input (workouts, measurements, etc.)
- You grant us a license to use your data to provide and improve the App
- You may not copy, modify, or distribute any part of the App without permission
## 8. User Content
- You are responsible for all content you submit to the App
- You grant us a non-exclusive license to use, store, and process your content to provide services
- We may remove content that violates these Terms
## 9. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
## 10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
- The App will be uninterrupted or error-free
- Results from using the App will be accurate or reliable
- The App will meet your specific requirements
## 11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMBO SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, or goodwill
- Personal injury or property damage resulting from your use of the App
- Any amount exceeding the fees you paid to us in the past 12 months

- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
## 13. Termination
- You may stop using the App and delete your account at any time
- We may suspend or terminate your account if you violate these Terms
- Upon termination, your right to use the App ceases immediately
- Provisions that should survive termination will remain in effect
## 14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance of the new Terms.
## 15. Governing Law
